Facebook has applied to trademark its name and faces for data aggregation purposes. A Facebook spokesperson said: "We apply for trademark protection when we believe our brand is being associated with or used in a way that is misleading or deceptive." Salesforce is exploring data collection tools that make use of facial recognition technology. Salesforce officials said: "We provide a free tier of security for HIPAA covered entities, and we're considering providing free, standalone facial recognition capabilities for the security needs of Salesforce customers. We're also evaluating the security, usability, and privacy attributes of leading third-party vendors to help them reach customers that use our technology."

The California Board of Equalization (BOE) has modified its draft advisory report to clarify the public disclosure of data collection software used to aid in tax investigations. Originally, the BOE recommended that the public should be made aware via reports to the Legislature and the Governor, and that "persons subject to felony tax investigations" should be required to ask for approval before using nontraceback client communication software.

The California Legislature has passed Assembly Bill (A.B.) 2434. The bill updates the California Consumer Privacy Act of 2018, California's data breach notification law. However, A.B. 2434 does not take effect unless a later-passed bill that creates a data breach notification fund is enacted. A.B. 2434 does not require disclosure of the data being sought after, trigger a public right to request information about themselves, nor does A.B. 2434 affect the personal information rights of those subject to data collection software.

Governors Association officials said they did not support A.B. 74. They said the bill would "unnecessarily complicate an already complex patchwork of state laws, and would not make California safer because the bill does not require the disclosure of what data is kept or the format in which it is kept."
