In March, the New York State Department of Financial Services released a series of proposed regulations to adopt the use of cryptocurrencies in business. However, the agency will be following the April 1 deadline set by the state legislature to ensure that the digital currency can be utilized by businesses without the fear of a serious crackdown.
The proposed rules ban all payments with bitcoin and other digital currencies in any form, except for transactions where there is a good reason for using the currency and that transaction has been authorized by a financial institution or a licensed money transmitter.
The department will establish a licensing program for companies that transact in virtual currencies. “The agency will also establish a bureau responsible for monitoring the industry and encouraging best practices and consumer protection,” stated the agency.
Under the proposed rules, any business offering any kind of financial services to consumers will need to disclose if it uses or has an interest in digital currencies.
The new rules will require that companies providing any kind of financial services, whether it’s a savings account, a loan, and a credit card to a consumer have a “reasonable basis to believe” that the services are to be provided in bitcoin.
Any businesses that do not receive payments in bitcoin will be regulated as money transmitters. Therefore, they will have to obtain a license to operate and will be subject to the following requirements:
– Must register and comply with all applicable federal, state, local, and foreign laws
– Must hold a Money Transmission Certificate and comply with the money transmission laws of each state where it is required to conduct money transmission
– Must comply with the current Know Your Customer (KYC) and Anti-Money Laundering (AML) regulations
The department of financial services expects to receive public comments on the proposed rules by April 5.
